[4:30] Good evening, Miss Better Brazo. [4:32] Good evening, Madam Chair. Present. [4:34] Good evening. The floor is yours, Mr. [4:36] Stebridge. [4:37] Thank you, Madam Chair. Uh we'll start [4:40] we'll go to the hearing schedule for [4:42] 5:00 p.m. for today. [4:45] We'll begin with case BOA1855587 [4:52] with the address of 34 to 36 Cohass [4:56] Street. If the applicant andor their [4:59] representative are present, would they [5:01] please explain this case to the board? [5:05] Hello. Good evening all. [5:09] We propose to extend the deck back [5:13] as I I'm not sure if you guys have the [5:16] sheet, but I'm trying to look at the [5:19] picture you have. Right there is fine. [5:21] Perfect. So, we are proposing to extend [5:24] that deck back towards the backyard 6 ft [5:29] towards the back and with an approximate [5:31] left to right sideways dimension of [5:34] 11.5. [5:35] We will not be encroaching on the side [5:38] setback at all. We're going to stay [5:40] within the same plane that the deck is [5:42] now just to go in the back, just to go [5:45] back six feet. We also propose to change [5:48] the deck boards, but I don't think [5:49] that's why we're here. But we want to [5:50] change the deck boards on the deck to a [5:52] different color, [5:55] but I don't think that's the reason why [5:56] we're here. I think it was because of [5:58] the extension. [6:02] Okay. Any questions from the board? [6:04] Hearing [6:06] none. May I have public testimony? [6:13] Madame Chair, I see any hands raised at [6:15] the moment. [6:17] My apologies. [6:19] Yes, ma'am. Madam Chair, um Madam Chair, [6:22] members of the board, for the record, my [6:23] name is Jeremy Benbury. I am the [6:24] Roslandale community engagement special [6:27] for the office of neighborhood services. [6:28] The applicant has completed the [6:30] community process which consisted of a a [6:32] Butters meeting facilitated on June 22nd [6:34] with Noah Butters in attendance. Next, [6:36] the opponent was encouraged to reach out [6:37] to the Civic Association West Village [6:39] Neighborhood Association and in doing so [6:41] completed the community process. Thank [6:42] you for your time in the Mayor's Office [6:43] of New Services would like to defer to [6:45] the board for their judgment. [6:47] Thank you, Madam Chair. No additional [6:50] comments. With that, may I have a [6:52] motion? [6:53] Madam Chair, it seems like a pretty [6:54] straightforward project. I'd like to [6:56] make the recommendation of approval. Is [6:58] there a second? [7:00] Second. [7:01] Mr. Stebridge? [7:03] Yes. [7:04] Miss Better Braza? [7:06] Yes. [7:07] Chair votes yes. The motion carries. [7:08] Good luck, sir. [7:10] Thank you. [7:13] Next, we have case BOA [7:16] 1825484 [7:21] with the address of 18 Hayes Road. if [7:24] the applicants and or their [7:26] representative present, would they [7:28] please explain? [7:29] Sure. Hello. Uh my name is Tim Sheen. [7:31] I'm the architect for the project. Um 18 [7:34] 18 Hayes Road is a single family um sing [7:38] raised single floor hip roof. Uh about [7:42] 25 wide, 43 long. Um my clients would [7:46] like to extend living space up into the [7:48] attic. Um there it is. Yeah, we'd like [7:52] to get [7:54] I don't Yeah, what we'd like to do in [7:56] that unfinished attic is save the front [7:59] dormer, make it a small kind of lowest [8:01] sitting area, and then we'd like to get [8:03] three bedrooms and a bath up there. To [8:05] do that, we'll need three dormers, one [8:08] at the back, one on each side. Um, low [8:11] slope, you know, low slope dormers. Um, [8:15] our only violation is a side setback [8:17] violation. There's a 10 foot required [8:19] either side. We've got nine on the [8:22] right, I think 8.8 on the left. So, by [8:25] running the dormers out to the to the [8:27] wall, you know, to the exterior wall, [8:29] we're penetrating this uh setback. Um [8:32] that's essentially it, you know, that's [8:34] that's what we're trying to do. Um [8:35] that's our only violation. So, I'll I'll [8:37] send it back to you. [8:39] Thank you. [10:22] We using the same uh uh [10:27] dimensions at the existence [10:30] uh respective footprints. Same [10:32] footprints. I mean uh it's going to be [10:34] two two additional bedrooms for the [10:36] second floor. Um gable roof lower than [10:40] existing one. It's only about 15 ft [10:42] above the uh the second the first floor [10:46] uh roof lower than the existing uh roof. [10:51] No attic, just a crawl space on on the [10:55] roof. [10:59] Questions from the board. [11:02] May I have public testimony? [11:04] Madame chair and members of the board. [11:05] For the record, my name is Jeremy [11:07] Benbury. [11:53] Next we have case BOA [11:56] 182 [11:57] 7848. [11:59] Much everyone [12:03] with the address of 615 to 619 Center [12:07] Street. It's the applicant andor their [12:10] representative present. Would they [12:12] please explain? [12:14] Hi, my name is Jose. I am Cafe Cella for [12:17] some reason. The applicant has [13:22] completed the community process uh which [13:23] was not a full process was not required [13:26] uh to remove the provisal. Our office is [13:28] confident that no uh that there would [13:30] not be a uh controversial uh proposal [13:33] and a full process was not required. uh [13:39] uh for the process. Excuse me. Thank [13:41] you. Uh [13:42] the mayor's office of neighbor services [13:43] would like to defer to the board for [13:44] their judgment. [13:48] Madame chair, no additional comments. I am [14:36] the homeowner at 24 Rosecliffe. Uh, we [14:38] are just looking to turn the attic space [14:40] into living space. Uh, to do that, we [14:43] would need to put on a dormer on the [14:45] staircase side for headroom and for the [14:48] bathroom. Um, we're going to be putting [14:51] a a bedroom and a bathroom and a closet [14:53] up there. [14:57] That's pretty much it. [14:58] Okay. Thank you. Questions from the [15:00] board? [15:02] May I have public testimony? Madame [15:04] Chair and members of the board, for the [15:05] record, my name is Jeremy Benbury. I'm [15:07] the Rosendale community engagement [15:08] specialist for the Office of [15:09] Neighborhood Services. The applicant has [15:11] completed the community process which [15:13] consisted of an excuse me, which [15:14] consisted of an office of neighborhood [15:16] services notification flyer notifying [15:18] Abutters of the proponent's intention. [15:20] Uh next, the proponent was encouraged to [15:22] reach out to the West Village [15:23] Neighborhood Association, which [15:24] completed the community process. Thank [15:26] you for your time, and the mayor's [15:27] office of neighborhood services would [15:28] like to defer to the board for the [15:29] judgment. [15:31] Thank you, [15:32] Madame Chair. We don't have additional [15:34] comments. [15:35] May I have a motion? [15:37] Madam Chair, I like to put forward a [15:38] motion of approval. [15:40] May I have a second? [15:42] Second. [15:43] Mr. Stebridge? [15:46] Yes. [15:47] Miss Better Braza? [15:48] Yes. [15:50] Chair votes yes. The motion carries. [15:51] Good luck. [15:52] Thank you. [15:56] And next we have case BOA [16:00] 1783948 [16:04] with the address of 1117 to 1125 Blue [16:09] Hill Avenue. [16:11] If the applicants andor their [16:13] representative are present, would they [16:15] please explain? [16:18] Good evening, Madame Chairman and [16:20] members of the board. My name is Juan [16:21] Roas and I'm the contractor for 117 125 [16:25] Avenue. They are a business that's been [16:28] operating there for the last 40 plus [16:31] years and there a provisor for the [16:33] applicant only. So my customer, my [16:36] client would like to get the provisor [16:38] removed so they could continue doing [16:39] business as it was. There was no work [16:40] done on the premises beside cosmetic [16:43] work. [clears throat] [16:44] So just a question that there seems to [16:47] be can you can you just clarify what the [16:49] business is? There seems to be some [16:51] abundance community gathering with a bar [16:55] and night entertainment [16:58] and what are the hours? [17:01] Uh Wise is here at she's the working [17:04] with the father on the proposal one. [17:06] Could you answer that question? [17:07] Hi. Yes. Um the hours is from 9 to like [17:13] basically all day till 2:00 a.m. [17:16] is what the liquor license is approved [17:18] for. This is daily. [17:21] Yes, but we won't be open every single [17:23] day. [17:24] Okay. What the license is the liquor [17:27] license was approved for previously. [17:31] Are there questions other questions from [17:32] the board? [17:34] How many uh what's the capacity? [17:39] How many patrons can be in there? [17:42] Um, I'm not 100% sure, but it was um [17:48] 500. [17:53] Okay. [17:56] And with the look, if I heard you [17:58] correctly, liquor license, so you open [18:00] until 2:00 a.m. [18:02] Yes. [18:05] Thank you. [18:08] May we have public testimony? [18:12] Madame chair and members of the board, [18:13] for the record, my name is Jeremy [18:14] Benbury. I am the Madapan community [18:17] engagement specialist for the office of [18:18] neighborhood services. The applicant has [18:20] completed the community process which [18:22] consisted of an abutters meeting [18:23] facilitated on May 6th with no abutters [18:26] in attendance. Uh it is important to [18:30] note that there was a second meeting for [18:32] licensing that many of us attended and [18:35] voiced uh their opinions that were more [18:39] uh zoning board uh related uh according [18:41] to the uh feedback that was received uh [18:44] for the meeting. [18:47] Uh but were not uh in approval of the [18:50] location uh and they cited a lot of [18:54] reasons uh regarding that. I can read [18:57] off the testimony for that uh if [18:59] necessary again uh but they did complete [19:01] the community process for the aboters [19:03] meeting uh on May 6 uh with no abutters [19:06] in attendance. Uh next the proponent was [19:10] encouraged to reach out to the civic [19:12] association greater manipan neighborhood [19:13] council to complete the community [19:14] process. To date our office has received [19:17] one letter in opposition to the proposal [19:18] stating the community has already [19:20] experienced a nightclub in the area and [19:22] does not want another citing a number of [19:24] concerns. Again, those concerns uh were [19:27] uh iter stated at the uh meeting for the [19:31] licensing meeting uh for the location. [19:36] Sorry, Mr. Member, I may have missed you [19:38] missed a comment earlier. You were [19:40] saying that Abutter's concerns were more [19:42] related to zoning or more related to [19:44] licensing. [19:45] Uh so during the licensing meet uh for [19:48] the licensing, their concerns were [19:50] regarding the location itself, which [19:51] would be the zoning aspect. They did [19:53] mention their concerns for the uh uh the [19:56] uh the entertainment as well, but their [19:57] concerns are more are more uh are uh [20:01] more focused uh on the uh on the the the [20:05] zoning aspects, the actual uh the actual [20:08] uh proposal being there uh at the old [20:12] page location. Yeah, I think what's what [20:15] I'm what I need clarification on is um [20:20] the relief that's being seekd is for a [20:23] conditional use. Um is that right to [20:26] continue the operation [20:28] of um having live entertainment which is [20:32] a forbidden use or because in the BPD [20:37] recommendation it specifies a violation [20:41] for it to be a change in in takeout [20:43] proviso. So I I I would like [20:47] clarification. What is the relief being [20:49] seek for? [20:51] I we put the entertainment license in [20:53] and the the takeout part of it and [20:56] entertainment. So for all of the above [20:58] actually [20:59] the [21:00] entertainment license but we don't we [21:01] don't [21:02] they they have [21:03] they don't do entertainment licenses. [21:04] Understood. So they're just looking for [21:06] the takeout and the and and the continue [21:08] on the hours of the operation. [21:11] The takeout take out of what? [21:13] Food. [21:13] Yeah. You mentioned you were a bar. Is [21:15] there food? A food. [21:22] That is correct. Yeah, there is food at [21:24] this takeout as well as uh the bar in [21:27] the place on with a legal license until [21:29] 2 a.m. in the morning. [21:31] Yeah, I mean I would like to get um [21:34] clarity from Caroline if she's on. [21:40] If not, I would recommend to kick this [21:42] to a full board. [21:45] Agreed. Yeah, [21:47] but I but I but it'll be good to hear we [21:49] have concerns because it seems I I guess [21:53] my concern is is that no one's here. It [21:55] seems like a it seems like a big impact. [21:59] Um [22:00] and I feel like I'm not fully [22:02] understanding all of the issues. [22:05] Uh so that's that's all of my concerns. [22:08] Thank you. So let's do this. [22:09] [clears throat] Let's uh take public [22:11] testimony and then when we get to the [22:13] motion if uh if that's the motion then [22:15] that's what we'll go with. Uh so uh can [22:18] we have public testimony please? [22:19] Sure. Uh we have Yolanda. Yolanda if you [22:23] can speak now. [22:25] Can you hear me? [22:26] Yes ma'am. [22:27] Yes. Um case so my name is Yolanda [22:30] Anderson. I've been living in um in the [22:33] area for 48 years. [22:38] We can't hear you, ma'am. [22:40] Is and K's have been [22:42] Can you hear me? [22:43] No, we can. Yes. [22:45] Okay. So, K has been in the area for uh [22:47] quite a few years. Many, many years. [22:49] Miss Kay has had the facility. One part [22:51] of the facility was a hair salon and the [22:54] other part was a function hall and she [22:57] ran it. Uh, you know, people would have [23:00] functions there off and on. But the [23:01] problem is is that Miss Ortiz want to [23:04] run the facility and have it 7 days a [23:07] week from Sunday to Saturday and K does [23:09] not hold 500 people. Has never held 500 [23:12] people in 48 years of being there. So [23:16] I'm opposing only because it's going to [23:19] bring a lot of noise, crime, and Matipan [23:23] is Matipan and Dorchester is already [23:25] crimeridden. We don't need another club. [23:28] On every block from Blue Hill down, [23:31] there is a liquor store on every corner. [23:34] I don't think we need another um open [23:38] bar seven days a week. And behind K's is [23:42] also a um [23:46] uh human services uh owned by FinFinn, [23:49] which there's mentally ill patients [23:50] there, you know, and the people that [23:53] live there. Think about their [23:55] well-being, the the noise, the the the [23:58] traffic it's going to bring. And they've [24:00] already been hanging out there um [24:04] having chairs set up and playing music. [24:08] So, I think Miss Ortiz need to figure [24:10] out um if she wants to have this place [24:12] as a function hall, which I don't, you [24:14] know, I don't mind, but seven days a [24:16] week from 9 to 2 in the morning. No. [24:21] Thank you. [24:22] Okay. Next we have a Fatima. [24:27] Uh good evening. Um thank you madam [24:29] chair. My name is Fatima Salam. I'm the [24:32] chair for the greater manipan neighbor [24:34] council. Um I attended the Butters [24:36] meeting that was uh I believe last month [24:40] as Jarvin Benbury had stated. At the [24:43] meeting um it was unanimous what I saw [24:47] by the um director Butters who live on [24:50] Havlock Street that they do not want uh [24:54] to have that level of entertainment [24:57] seven days a week right next door to [25:00] them. there are um already issues going [25:04] on that they had stated quite candidly [25:08] uh in the meeting. The other issue this [25:11] um right now the proviso that um you had [25:15] asked about was specifically given in [25:18] 2019 [25:19] to K's Oasis. [25:22] The reason being that it is an [25:24] entertainment license [25:26] that and there is and there is alcohol [25:28] served. That is the reason why it is was [25:31] not going to be something that was light [25:34] done lightly. Miss K's Oasis had already [25:38] been a business for a long time inside [25:40] of the community. That's why it was not [25:43] automatically transferable. The concerns [25:45] that also are there are that uh Miss [25:48] Ortiz does not when she was asked at the [25:51] Butters meeting if she has experience in [25:54] this type of business, she says she does [25:56] not, but that she has a partner who [25:58] does. Considering the level of occupancy [26:03] that we were told that was given at the [26:05] site, those were the service concerns. [26:08] But the most concerning part was one in [26:12] which uh members Sergeant Harris who's [26:15] there at the meeting and asked [26:17] Oh, okay. [26:22] I guess times up. [26:24] We appreciate the context. Uh that [26:26] that's that's super helpful. Um any any [26:30] other um raised hands, Jesus? [26:33] Madam Chair, we don't have anything. [26:34] Madam Chair, this is Stephanie from the [26:36] um from the board. Yes, please. [26:38] So, like she said, in 2019, it came in [26:41] front of the ZBA board to change the [26:43] occupancy to include bar with live [26:45] entertainment to the existing function [26:48] hall with no work to be done. On that [26:50] decision, um there was a proviso granted [26:53] to this petitioner only. What's before [26:56] the board today is just to remove that [26:59] proviso. [27:02] So, this to the prior um uh prior order, [27:06] you mean? Correct. [27:08] Well, that's what I was going to ask. [27:09] This is a whole new ownership, correct? [27:11] That's why the [27:13] That's why that provides [27:15] Thank you so much, Stephanie, for that [27:17] context. [27:19] I think Caroline is here. [27:22] [clears throat] [27:23] Caroline, do you want to add to that? [27:29] Did you say she was here? Jesus. [27:31] Yeah, Madam Chair. Sorry, I was having [27:33] issues with the audio. Yes. So what [27:35] Steph saying is correct. It's not just [27:37] about it's not take out. It's just to [27:39] pro remove the proviso to this [27:41] petitioner only [27:44] for what? For all of the above for the [27:47] entertainment and the and the takeout or [27:50] just take out. [27:52] Correct. [27:54] No, for all of the above. It's what the [27:56] for the from the 2019 decision. If [27:59] Stephanie can say that again. [28:02] Yes, I can repeat it. Yeah. Yeah. [28:04] From the 20 the 2019 decision, it was to [28:07] change the of occupancy to include bar [28:10] with live entertainment to the existing [28:13] function hall. No work to be done, [28:15] right? Because it's a conditional use. [28:18] And do and do we know I mean I'm I'm [28:20] sure the the previous um [28:25] uh res resident knows the answer to this [28:28] uh whether the parameters uh the hours [28:31] and you know etc are the same or [28:34] different. It sounds like they're later [28:37] it's later and day like more frequent. [28:41] Can the applicant confirm that? Um yes, [28:46] everything. So I heard the comment about [28:49] the capacity, the occupancy. Um we [28:53] didn't change anything about the [28:55] occupancy. That's what um Miss K was [28:58] already approved for before. We didn't [29:02] change anything to that. Like it's just [29:04] what she was already approved for. And [29:07] um I believe her she also was approved [29:10] until 2:00 a.m. We are also not looking [29:12] to um be open 7 days a week. We are also [29:18] using like trying to function as a [29:20] function hall. So if someone did want to [29:22] rent the space out during the week, [29:24] they're able to, but we got we would not [29:26] be open all seven days. [29:29] Uh this is either a question for the [29:31] applicant or maybe Jeremy knows the [29:33] answer to this. So is there a next step [29:36] to this? Are they are they do they need [29:38] to go before the licensing board or is [29:40] this it? [29:42] Uh so next yes madam uh madam chair they [29:45] will be going to the licensing board. Uh [29:47] that is specifically for again not with [29:49] the takeout but the other provisors that [29:51] were mentioned uh live entertainment uh [29:53] and the alcohol [29:55] uh as well as the hours of operation uh [29:58] from 9:00 p.m. which we have as 9:00 [30:00] p.m. to 2 am. [30:02] Okay. And the liquor meaning [30:04] transferring a license or getting a new [30:06] license or [30:07] Yes, ma'am. This is going to be the [30:08] transfer of the license from 879 blue to [30:10] 117 1125. [30:12] Thank you, ma'am. [30:14] Other questions or comments from the [30:16] board? [30:19] Are you ready to make a motion? [30:21] Uh, yes, Madam Chair. I think um I would [30:25] like to put forward a motion um of [30:28] deferral for our next full board hearing [30:32] that would give an opportunity [30:34] uh to provide this context and to allow [30:37] for community members to uh be notified [30:42] uh of this um continuation of [30:45] conditional use but to remove the [30:47] provisa of the previous applicant. Uh it [30:50] would be good for the applicant to um [30:55] provide potentially documentation of the [30:57] existing floor plan um and uh what it's [31:02] already kind of been approved in terms [31:04] of the terms just to provide some some [31:06] background uh and to also just [31:09] articulate the intentions [31:11] um of that transfer and its use. Thank [31:14] you. [31:16] Thank you. Is there a second? [31:19] Second, [31:21] Mr. Stebridge. [31:23] Yes. [31:24] Miss Better Braza? [31:26] Yes. [31:26] So, the [31:27] chair votes chair. I'm sorry, Stephanie. [31:30] No. Go ahead. [31:31] Okay. Chair votes yes. The motion [31:32] carries. Do we have a a date? [31:34] The dates the dates that we have is um [31:36] September 22nd or October 6. [31:41] So, uh [31:44] what is preferable for the applicant [31:46] with the October 6? I mean, that will [31:48] give you enough time to gather [31:49] everything. [31:50] Okay. Does that work, Stephanie? [31:52] October 6 is fine. So, we're going to do [31:54] October 6 at 9:30. [31:57] Okay. [31:57] Stephanie, can you can you please um [32:00] like update the description so that the [32:03] committee members know what's be in [32:06] front of them because I found the [32:07] description to be not specific enough. [32:11] Um I would have to speak to the plans [32:13] examiner. They're the ones who handle [32:15] that portion. [32:18] Thank you. [32:19] Thank you. Jeremy, are you adding [32:22] something? [32:23] Uh, yes, ma'am. I would I just wanted to [32:25] confirm is this to uh will we be doing [32:27] the process over again with the new uh [32:29] refusal letter with for more [32:30] clarification uh and recirculating that [32:33] flyer and holding another meeting? [32:35] So, does that mean the October 6th would [32:37] be too soon? [32:38] If that's the case, October 6th is too [32:40] soon. Yeah, I think [32:41] though it's going to have to be November [32:43] 10th [32:44] cuz the October 27th hearing was [32:47] cancelled, [32:48] right? [32:49] Okay. So, can the applicant confirm that [32:51] date works for you? If not, then [32:52] Stephanie will look for the date after [32:54] that. November 10th is what? [32:56] November 10th and November 17th. [33:00] And I would also encourage the applicant [33:02] to gather supporting supporting letters. [33:06] Um and and we heard from Fatima, you [33:09] know, sorry that we're asking you to [33:12] come in front of the board, but I would [33:14] I would encourage you do so. I thought [33:16] that context was helpful, but I really [33:18] do agree that the committee members need [33:21] to know uh because they're going to be [33:24] the ones that are impacted by this. [33:26] Thank you. [33:29] Okay. Can the applicant confirm [33:31] works? [33:32] Okay. [33:32] Thanks, Mr. [33:34] Thank you. So, we will see you then. And [33:36] uh I'll thank everyone for your service [33:38] today. [33:39] Kim, [33:40] thank you. Have a good evening. [33:42] Have a good evening, folks.
